
Purpose
This document describes the procedure to be followed for identifying policies for developing and maintaining a comprehensive registry of regulatory and voluntary requirements applicable to Twean Construction Company Ltd and having access to these regulations and other legal requirements.
Scope
This procedure covers laws, regulations, and other requirements established by the Republic of Kenya, NEMA Kenya, and all other regulations that may apply to the environmental aspects and Occupational Health and safety hazards of Twean Construction Company Ltd.

Legal requirements: Any applicable state and local environmental regulations
Responsibilities and Authority
- The EHS Manager shall have the overall responsibility for the EHS performance.
- Department heads in conjunction with the EHS and Management Representative are responsible for identifying and analyzing environmental and Safety regulations and other legal requirements relevant to their activities.
Method
Determination of the Type of Regulatory Requirement to be identified
EHS Manager shall identify the relevant EHS laws, regulations, and industry standards Twean Construction Company Ltd adheres to. This may include international, state, and local regulations.
Impacts
EHS Manager shall prepare a listing of major areas of the EHS impacted by the department operation; such as in Risk Assessment and Evaluation will be made. The list will also include major types of wastes or products that the operation generates or utilizes such as domestic waste, chemical waste, waste oils, hazardous waste, paper, scrap metals, scrap batteries and glass. This list shall be reviewed in cases where new processes are identified.

Means and methods to identify legal and other requirements include, but are not limited to, the following:

- Ministry of Water and Environment,
- Emergency Response Procedure for Twean Construction Company Ltd,
- The Department of Occupational Safety and Health.
- KLII (Kenya Legal Information Institute)
If the departmental operation impacts a component of the EHS, the EHS Manager shall consult NEMA or the corresponding government Ministry or agency for regulatory requirements that may apply.
Regulatory Services
The National Environment Management Authority and the Ministry of Labor under the Department of Occupational Health and Safety are the regulatory bodies in Kenya. They shall be consulted either online or directly for relevant regulations. The above will have relevant references to other government regulations to be checked for other regulatory requirements impacting departmental operations.
New Project or Change to Existing Operation
Each department in conjunction with the EHS & Management Representative shall review EHS requirements prior to the initiation of new projects or modification of an existing operation. The Company lawyer/alternative person and EHS Manager shall head check and coordinate with Design and Construction to ensure applicable city and county codes are identified and met. Where Risk Assessment studies are necessary by law, these shall be undertaken as per the Risk Assessment regulations.
Legal Register
A listing of the regulations shall be maintained, by paper file or electronically, and updated as necessary.
A legal register itemizing these regulations shall be kept by the EHS office.
